These SMS Terms and Conditions govern the Cactus Jack’s Hiring and Employee Text-Messaging Program operated by Cactus Jacks Bar & Grill Corp., doing business as Cactus Jack’s.

Cactus Jack’s Hiring and Employee Text-Messaging Program

Cactus Jack’s sends transactional and conversational text messages to job applicants and employees who voluntarily consent to receive them.

Messages may include:

• Application confirmations
• Interview scheduling links
• Interview confirmations and reminders
• Rescheduling or cancellation notices
• Hiring-status updates
• Employee portal invitations and access notices
• Training assignments and reminders
• Training-document notifications
• TABC and Food Handler certificate reminders
• Certification-expiration notifications
• Policy acknowledgments
• Electronic-signature verification codes
• Employee document notifications
• Responses to applicant or employee questions

This program is not intended for unrelated advertising or third-party marketing.

By providing your mobile telephone number and voluntarily selecting the separate SMS-consent checkbox on a Cactus Jack’s application or employee portal, you agree to receive recurring transactional and conversational text messages from Cactus Jack’s.

The SMS checkbox is separate from other agreements and is unchecked by default.

Consent to receive text messages is not a condition of:

• Submitting an employment application
• Scheduling or attending an interview
• Receiving an employment offer
• Being hired
• Maintaining employment
• Accessing required employment or training information through another available method

You may also opt back into the program by texting START, YES, or UNSTOP to the Cactus Jack’s messaging number.

Message frequency varies based on your application, interview schedule, employment status, training assignments, certification requirements, requested verification codes, and interactions with Cactus Jack’s.

You may receive multiple messages during an active application, interview, onboarding, training, certification, or document-verification process.

Message and data rates may apply according to the terms of your mobile telephone plan.

Cactus Jack’s does not charge a separate fee for participating in this text-messaging program.

You may stop receiving text messages at any time by replying with any of the following keywords:

STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, or OPTOUT

After you opt out, you will receive a final confirmation message. You will not receive additional messages from this program unless you opt in again.

You may opt back in by texting START, YES, or UNSTOP, or by completing the original opt-in process again.

Opting out of text messages does not prevent Cactus Jack’s from contacting you through another lawful method when necessary.

Carriers are not liable for delayed or undelivered messages.

Message delivery is subject to your wireless carrier’s network availability and cannot be guaranteed.

By enrolling, you confirm that:

• You are the subscriber or authorized user of the mobile number provided.
• The mobile number you provide is accurate.
• You will notify Cactus Jack’s or opt out if the number changes ownership or you are no longer authorized to use it.
• You will not permit another person to use a verification code intended to confirm your identity or signature.

If your mobile number changes, you should opt out from the previous number and complete the consent process using your new number.

Cactus Jack’s may send one-time verification codes to help confirm employee portal access, document acknowledgment, or electronic signatures.

Verification codes are intended only for the person associated with the receiving mobile number. Do not share a verification code with a manager, coworker, applicant, employee, or other person except when personally entering it into the authorized Cactus Jack’s verification screen.

Cactus Jack’s will never ask you to provide a password through an unsolicited text message.

Participation in this messaging program does not:

• Guarantee an interview
• Guarantee an employment offer
• Create an employment contract
• Change an employee’s at-will employment status when applicable
• Replace official policies, notices, or employment records
• Guarantee continued employment

Text messages are provided as a communication convenience. Applicants and employees remain responsible for reviewing official information made available through the appropriate application, employee portal, manager, or company representative.

Mobile telephone numbers, SMS opt-in information, and messaging consent records will not be sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes.

Cactus Jack’s may change, suspend, or discontinue the text-messaging program or any of its features when reasonably necessary.

We may revise these SMS Terms and Conditions by posting an updated version on this page. Continued participation after an update is subject to the revised terms and any consent requirements imposed by applicable law.

These SMS Terms and Conditions are governed by applicable federal law and the laws of the State of Texas, without regard to conflict-of-law principles.
